Spire Spotlight | Nestle Purina Resolves Contractor Dispute on Expansion of Dog Food Production Facilities with Spire’s Support

Nestle Purina’s Petcare division initiated the CONAN Project to expand its dog food production facilities in Clinton, Iowa, and Mechanicsburg, Pennsylvania, in response to increased market demand. The project involved the addition of two new production lines at each facility within the existing infrastructure. During construction, Nestle Purina terminated its contractor and took over the completion of the project, later seeking compensation for additional costs and damages incurred.

Spire Consulting Group was retained by Nestle Purina to evaluate the contractor’s performance and quantify damages related to its termination and project completion. This included assessing the contractor’s performance regarding quality of work, safety, schedule management, and calculating contract adjustments, costs to complete the work, correcting deficiencies, and liquidated damages. Spire supported Nestle Purina during the mediation phase and through the litigation process until a settlement was achieved.

Nestle Purina successfully reached a confidential settlement with the contractor in late 2022, enabling the company to complete the project and place the expanded facilities into service to meet rising market demands.
