The City of Corpus Christi engaged a contractor to make improvements to an existing lift station and force main to support increased capacity demands. However, the contractor performed deficient work on the project, did not meet the schedule, and left the project prior to completion. The City had to terminate the contractor. The contractor claimed it had complied with contract requirements and completed its work.
Spire was retained to determine if the contractor met its standard of care obligations in performing the work, if it complied with regulatory requirements, if it progressed the work in a timely manner, and if it left the project prior to completion of all the contracted scope of work. Spire analyzed project documents, including the contract, change orders, schedule updates, payment applications, and other project communications. Additionally, Spire interviewed project staff and toured the site. Spire performed a thorough analysis of the contractor’s performance, a schedule delay analysis, and a quantification of damages analysis. Through these analyses, Spire found that the contractor failed to meet its Standard of Care obligations, failed to provide adequate resources, failed to meet the schedule due to its own performance, and abandoned the project, causing the City damages.
Spire’s reports helped the City in its negotiations with the contractor. The City was able to avoid an expensive trial with the contractor.
The Contractor withdrew its claims, and the parties reached a settlement with terms very favorable to the City.
