Voestalpine is the owner of the world’s most advanced and environmentally-friendly direct-reduction facility in Nueces and San Patricio Counties, Texas. The facility uses natural gas to reduce iron ore and produce hot briquetted iron (HBI). The project is designed to yield an annual capacity of approximately two million tons of HBI. Spire’s client, PHB Weserhütte, is an engineering company specializing in the design and construction of material handling systems, including related conveyor belt systems.
Spire’s experts were retained to help the client respond to claims brought to light by the owner on one of the two work packages awarded to them. Spire’s consultants performed an in-depth schedule analysis, a contract and changed work analysis, and an acceleration analysis to quantify damages claimed by the owner. Spire also assessed the standard of care for various trades included in the contract. Spire utilized the schedule delay and quantification of damages analyses to write a report of findings to help the client defend their position during ICC Arbitration proceedings.
Spire’s client was successfully awarded over 90% of its damages consisting of over $17 million.
