EPIC Pipeline built a 700-mile 24” pipeline running from New Mexico to Southeast Texas. During the construction of the new pipeline, the excavation contractor hit an existing pipeline, causing several injuries. The owner of the existing pipeline sued EPIC and its consultants and contractors, including the client, for negligence. TMI Solutions, the client, was a consultant working to help develop the pipeline route and execute the project. TMI Solutions was accused of not identifying a crossing of the existing pipeline. Spire was retained to provide opinions regarding whether TMI contributed to the line strike and to evaluate the damages claimed by the existing pipeline owner.
Spire evaluated whether TMI Solutions met its standard of care regarding the development of pipeline design and project execution. Spire thoroughly reviewed contracts, meeting minutes, change orders, management of change documents, and other regulatory compliance documents. Additionally, Spire reviewed the project personnel depositions, developing its opinions. Spire also evaluated the damages claimed by the existing pipeline owner to identify issues with its calculations.
Through analysis, Spire found that TMI Solutions met its standard of care obligations and did not contribute to the pipeline strike. Furthermore, Spire found that the existing pipeline owner’s alleged damages were overstated and not supported.
Based in part on Spire’s opinions, the case settled with terms that were favorable to the client and covered by its insurance.
