In 2009, the City of San Antonio (City) entered into a construction contract with Texas Sterling Construction Co. (TSC) for the Bulverde Road (Loop 1604 to Evans) Project, Project Number 42-11121. This was a Construction Manager at Risk contract. Throughout the course of the work contemplated by the contract, TSC billed the City on a unit cost basis. After the work was completed, TSC requested an Equitable Adjustment, claiming there were various project delays alleged by TSC to have been caused by the City. After both parted parties made extensive efforts at settlement, TSC sued the City and served it in April 2018.
Spire Consulting Group, LLC (Spire) was retained by the City to assist in evaluating TSC’s damages claim. During phase 1 of this project, Spire performed an Early Case Assessment to the City of San Antonio. Through this presentation, Spire provided an overview of the project, summary of the dispute, position strengths and considerations, review of the contract and relevant documents, and preliminary schedule and cost analysis.
Spire was able to assist the City in reducing the General Contractor’s alleged damages and reaching settlement prior to litigation.
